I. Basic Provisions

Personal data refers to all information about an identified or identifiable natural person. An identifiable person is someone who can be directly or indirectly identified, especially by reference to a specific identifier, such as a name, identification number, location data, online identifier, or one or more factors specific to physical, physiological, genetic, mental, economic, cultural, or social identity.

II. Sources and Categories of Processed Personal Data

The controller processes personal data provided by you or obtained based on the fulfillment of your order.
The controller processes your identification and contact details and data necessary for contract performance.

III. Legal Basis and Purpose of Data Processing

The legal basis for processing personal data is:

  • Performance of a contract between you and the controller under Article 6(1)(b) GDPR.
  • Legitimate interest of the controller in direct marketing (sending commercial communications and newsletters) under Article 6(1)(f) GDPR.
  • Your consent to processing for direct marketing purposes (sending commercial communications and newsletters) under Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll. on certain information society services, unless goods or services have been ordered.

The purpose of processing personal data is:

  • Handling your order and fulfilling rights and obligations arising from the contractual relationship. Personal data necessary for successful order processing (name, address, contact) is required during the ordering process.
  • Sending commercial communications and marketing activities.

The controller does not/does conduct automatic individual decision-making as per Article 22 GDPR, with the explicit consent of the customer.

IV. Data Retention Period

The controller retains personal data:

  • For the duration necessary to fulfill rights and obligations from the contractual relationship (15 years after the relationship ends).
  • Until consent for marketing purposes is revoked, for a maximum of … [to be completed] years.

After this period, the controller deletes personal data.

V. Recipients of Personal Data (Subcontractors)

Recipients of personal data are:

  • Persons involved in delivering goods/services or processing payments.
  • Providers of operational services.
  • Providers of marketing services.

The controller does/does not intend to transfer personal data to a third country (outside the EU) or an international organization. Recipients in third countries may include providers of mailing and cloud services.

VI. Your Rights

Under GDPR, you have the right to:

  • Access your personal data (Article 15).
  • Rectify data (Article 16) and restrict processing (Article 18).
  • Erasure of personal data (Article 17).
  • Object to processing (Article 21).
  • Data portability (Article 20).
  • Withdraw consent for processing in writing or electronically to the address or email listed in Article III.

You have the right to file a complaint with the Office for Personal Data Protection if you believe your rights have been violated.

VII. Conditions of Personal Data Security

The controller has adopted technical and organizational measures to secure personal data.
Data storage and physical records are secured using antivirus programs, backups, and secure passwords.
Access to personal data is restricted to authorized personnel.

VIII. Final Provisions

By submitting an order, you confirm that you have read and accept the personal data protection conditions in their entirety.
You grant consent to these conditions by ticking the consent box in the online form.
The controller may change these conditions, publishing the new version on its website or sending it to the email provided by you. These conditions are effective from May 25, 2018.

Whistleblower Protection

In accordance with applicable legal regulations, Carlsbad Reality and Carlsbad Investment protect the rights of whistleblowers through the Internal Reporting System (VOS), allowing the reporting of potentially unlawful activities.

VOS serves employees and individuals with information about possible violations, such as criminal offenses or infractions with a minimum fine of CZK 100,000, or breaches of legal regulations.

All information submitted to VOS is confidential and processed according to law.
